Ontario issues new approval process for renewable energy projects

Ontario’s Green Energy Act (GEA), passed in 2009, is intended to create substantial employment in a green economy and reduce environmental impact in the province. The goal is to create over 50,000 “green collar” jobs and generate billions of dollars of economic growth in communities across Ontario by making it easier to bring renewable energy projects to life and creating a culture of conservation so that people can go about their daily lives using less energy.

Phasing out coal at Ontario Power Generation plants is the single largest greenhouse gas reduction initiative anywhere in Canada and is expected to reduce greenhouse gas emissions by up to 30 megatonnes. Replacing coal with other sources of energy—including emissions reducing renewable energy projects—is a key component of Ontario's Climate Change Action Plan, which includes the goal of phasing out the province’s coal-fired power plants by 2014.

The Renewable Energy Approval (REA), issued by the Ministry of the Environment, covers most renewable energy projects that generate electricity. REA combines previous requirements under the Environmental Assessment Act with clear provincial rules and standards in a new regulation under the Environmental Protection Act. The regulation became law on September 24, 2009.

Key steps within the approval process include:

  • Pre-submission work
    1. Describe the facility and project location.
    2. Assess and mitigate impacts and potential environmental effects associated with the project during:
      • Construction
      • Design and operation
      • Decommissioning
    3. Engage the public, municipalities and Aboriginal communities in discussions about the project
    4. If required, obtain a Development Permit issued by the Niagara Escarpment Commission
    5. Demonstrate how the project will meet setbacks depending on the class of project
    6. Prepare a report of the findings of any studies, along with their plans for constructing the project, operating and decommissioning the facility
  • Optional consultation on pre-submission work
  • Complete submission
  • Public notice to the Environmental Registry
  • Decision
